1. Introduction and Marketplace Model

Unlike a traditional retailer, DarePouch acts as a Marketplace. This means we provide a platform for third-party sellers ("Vendors") to list and sell nicotine pouches to adult consumers ("Buyers").

Role of DarePouch: We facilitate the transaction, process payments, and provide the technical platform. We do not manufacture the products sold on the Site.

Contract of Sale: When you purchase a product, the legal contract for the sale of goods is directly between you (the Buyer) and the Vendor.

5. Taxes, Duties, and Import Regulations

International Shipments: DarePouch and its Vendors cannot provide specific advice on import regulations for every country.

Buyer Responsibility: As the importer of record, you are personally responsible for knowing the laws regarding nicotine pouches in your destination country.

Duties & Fees: You are responsible for all applicable taxes, customs duties, and import fees. DarePouch will not refund orders seized by customs or returned due to unpaid duties.

6. Shipping, Returns, and Refunds

We aim to deliver your order within 2-4 business days after the order confirmation. Delivery times may vary depending on stock availability and the shipping address.

Shipping Costs: Shipping costs are calculated at checkout and depend on the chosen shipping method and order weight.

If your order is delayed, we will notify you as soon as possible using the contact information you provided.

Please note that delivery times may be longer during periods of high demand, such as holidays.

Shipping Methods: We partner with reliable courier services to ensure that your order is delivered safely and on time. You will receive an email with tracking information once your order has been dispatched.

Products are shipped directly by the respective Vendors or via our fulfillment partners.

Perishable Goods: Due to health and safety regulations, all sales of nicotine pouches are final.

No Returns: We cannot accept returns or exchanges on opened or unopened packages unless the product is damaged or incorrect upon arrival.

Issues: If you receive a damaged or incorrect item, you must contact thomas@outdare.co within 48 hours of delivery with photographic evidence.

DarePouch.com and its services are provided "as is" and without any warranty, express or implied.

We specifically disclaim implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the products sold by Vendors meet your expectations or that the Site will be uninterrupted or error-free.

10. Limitation of Liability

In no event shall DAREPOUCH OÜ, its officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages (including lost profits or health issues) arising out of:

The use or inability to use the Site. Products purchased from Vendors through the Site. Any content posted by third parties. Some jurisdictions do not allow the exclusion of certain warranties, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless DAREPOUCH OÜ and its affiliates from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law, or your use of products purchased via the Site.

12. Governing Law & Dispute Resolution

Any agreements entered into under these terms and conditions are governed by the law of Estonia. Any disputes arising in connection with your purchase from DAREPOUCH OÜ will be resolved by the courts in Estonia.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
