PLEASE READ CAREFULLY: These Terms and Conditions contain important information regarding your legal rights, remedies, and obligations, including strict age verification requirements and health warnings.

1. Introduction and Marketplace Model

Welcome to DarePouch.com (the "Site"), owned and operated by DAREPOUCH OÜ / reg. 17444706, Pärnu mnt 139b, 11317 Tallinn, Estonia ("DarePouch", "we", "us", or "our").

Unlike a traditional retailer, DarePouch acts as a Marketplace. This means we provide a platform for third-party sellers ("Vendors") to list and sell nicotine pouches to adult consumers ("Buyers").

Role of DarePouch: We facilitate the transaction, process payments, and provide the technical platform. We do not manufacture the products sold on the Site.

Contract of Sale: When you purchase a product, the legal contract for the sale of goods is directly between you (the Buyer) and the Vendor.

Product Liability: While we vet our Vendors, DarePouch expressly disclaims liability for the manufacturing safety, ingredients, or compliance of the specific products listed by Vendors.

2. Strict Age Requirement (18+ Policy)

You must be at least 18 years of age (or the legal age of majority to purchase nicotine products in your specific jurisdiction, whichever is higher) to access this Site or purchase products.

Age Verification: We reserve the right to use third-party age verification services to verify your identity and age. You agree to provide truthful and accurate information for this purpose.

Minors: Access by persons under the legal age is strictly prohibited. Falsifying your age to purchase products is illegal and may result in legal action.

3. Health Warnings & Risk Disclaimer

WARNING: This product contains nicotine. Nicotine is an addictive chemical.

Not for Non-Users: Products sold on DarePouch are intended for use by existing adult nicotine consumers only.

Health Risks: Nicotine pouches are not a smoking cessation product and have not been evaluated by the Food and Drug Administration (FDA) as such.

Consult a Doctor: You should consult with a healthcare professional before using these products, especially if you are pregnant, nursing, have high blood pressure, heart disease, or are taking medication for depression or asthma.

4. Account Security

You agree to maintain the security of your login credentials ("PID"). You are responsible for all activities and charges resulting from the use of your account on the Site, including unauthorized use prior to your notifying us of a security breach.

5. Taxes, Duties, and Import Regulations

International Shipments: DarePouch and its Vendors cannot provide specific advice on import regulations for every country.

Buyer Responsibility: As the importer of record, you are personally responsible for knowing the laws regarding nicotine pouches in your destination country.

Duties & Fees: You are responsible for all applicable taxes, customs duties, and import fees charged on arrival. Orders seized by customs cannot be refunded; if customs sends a parcel back to us, we refund it once it arrives.

6. Shipping, Returns, and Refunds

Shipping: Orders ship with tracking from our warehouse in Denmark; orders placed before 12:00 (Danish time) on a business day leave the same day. Delivery usually takes 2–5 business days in Europe and 4–10 business days to Canada. Shipping costs are calculated at checkout based on destination and order weight.

Products are shipped directly by the respective Vendors or via our fulfillment partners.

Returns: Unopened, unused products can be returned within 14 days of delivery, and DarePouch covers the return postage. For health and hygiene reasons, opened products cannot be returned.

Damaged, Incorrect or Missing Items: Contact support@darepouch.com within 48 hours of delivery with photographic evidence, and we will replace or refund the items concerned.

7. User Conduct & Submissions

You agree to use this Site only for lawful purposes. You shall not post or transmit any material that is unlawful, infringing, threatening, defamatory, or encourages criminal conduct. By submitting content (reviews, comments) to the Site, you grant DAREPOUCH OÜ a non-exclusive, royalty-free, perpetual license to use, reproduce, and display such content in connection with our marketing.

8. Intellectual Property & DMCA

DAREPOUCH OÜ respects the intellectual property of others. If you believe material on our Site infringes your copyright, please notify our designated agent at support@darepouch.com with the following:

Signature of the copyright owner. Description of the copyrighted work. Location (URL) of the infringing material. Your contact information. A statement of good faith belief that the use is unauthorized.

9. Disclaimer of Warranties ("As Is")

DarePouch.com and its services are provided "as is" and without any warranty, express or implied.

We specifically disclaim implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the products sold by Vendors meet your expectations or that the Site will be uninterrupted or error-free.

10. Limitation of Liability

In no event shall DAREPOUCH OÜ, its officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, or consequential damages (including lost profits or health issues) arising out of:

The use or inability to use the Site. Products purchased from Vendors through the Site. Any content posted by third parties. Some jurisdictions do not allow the exclusion of certain warranties, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless DAREPOUCH OÜ and its affiliates from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law, or your use of products purchased via the Site.

12. Governing Law & Dispute Resolution

Any agreements entered into under these terms and conditions are governed by the law of Estonia. Any disputes arising in connection with your purchase from DAREPOUCH OÜ will be resolved by the courts in Estonia.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
